Terms of Service

These Terms of Service ("Terms") govern your access to and use of Proudify ("the Platform"), operated by Obii Kriationz Web LLP ("we", "our", or "us"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use Proudify. By using the Platform, you represent that you meet these requirements.

2. Account Registration

  • Accuracy: You agree to provide accurate, current, and complete information during registration.
  • Security: You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately of any unauthorised access.
  • One account per person: You may not create multiple accounts to circumvent restrictions or billing.

3. The Service

Proudify allows you to create, issue, and verify digital certificates and credentials. Key terms of use:

  • Pay-per-certificate billing: You are billed per certificate issued. Charges are incurred at the time of issuance, not upon account creation.
  • Certificate packs: Prepaid certificate credit packs are non-refundable once purchased, except as required by applicable law.
  • No subscription required: There is no mandatory recurring subscription. You pay only for what you use.

4. Acceptable Use

You agree not to use the Platform to:

  • Fraudulent credentials: Issue certificates for achievements, qualifications, or courses that were not completed or do not exist.
  • Impersonation: Impersonate any person, institution, or organisation without authorisation.
  • Harmful content: Include illegal, defamatory, or obscene content in certificates or templates.
  • Platform abuse: Attempt to disrupt, hack, scrape, or reverse-engineer any part of the Platform.
  • Spam: Use the bulk email delivery feature to send unsolicited commercial communications.

5. Intellectual Property

  • Your content: You retain ownership of logos, designs, and text you upload. You grant us a limited licence to use this content solely to operate the Platform for your account.
  • Our content: The Platform, including its design, code, templates, and brand assets, is owned by Obii Kriationz Web LLP. You may not copy, resell, or redistribute any part of it.
  • Certificate templates: Default templates provided by Proudify are licensed for use within the Platform only.

6. Payments & Refunds

  • Payment processor: Payments are processed by Razorpay. By making a payment, you also agree to Razorpay's terms of service.
  • Per-certificate charges: Charges for individual certificates are non-refundable once a certificate has been issued and delivered.
  • Certificate packs: Prepaid packs are non-refundable. Unused credits do not expire but cannot be transferred to another account.
  • Disputed charges: Contact us within 14 days of a charge if you believe it was made in error.

7. Limitation of Liability

To the maximum extent permitted by law, Obii Kriationz Web LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or harmful components.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason with or without notice. You may close your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately.

10. Governing Law

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

11. Changes to Terms

We may revise these Terms at any time. Material changes will be communicated by updating the "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
